You understand and acknowledge that freenikah.com acts as an Intermediary as defined under clause (1) sub-clause (w) of Section 2 of the Information Technology Act, 2000. Free nikah.com is a brand owned by NIKA ONLINE PRIVATE LIMITED which owns, retains and has complete rights in free nikah.com and the freenikah.com Website /App/ free nikah.com Service.
The personalized matchmaking services offered by freenikah.com are provided by NIKA ONLINE PRIVATE LIMITED and are effective as of the date you sign up for the free nikah.com package for the duration of the applicable package that you choose (and is listed on this website). During the Tenure, freenikah.com will be an endeavor to assist you in finding your better half (prospect) through searching, short-listing, and contacting prospects.

Registration

b) freenikah.com cannot guarantee or assume responsibility for any specific results from the use of the data available from the free nikah.com service or from other matrimonial websites owned by Nike online.
c) Any member of freenikah.com may search for profiles, and the results of that search are automatically produced matches based on your partner preferences by free nikah.com. The automatic system-generated prospect results of the Website/App may also vary in accordance with any changes made by a free nikah.com user to their partner preferences.
d) We are unable to completely protect user data while it is in transit or stop any malicious third parties from interfering with the data before it reaches the free nikah.com servers.
e) No free nikah.com member is prohibited from expressing interest in your profile or contacting you depending on their partner preference. However, you have the freedom to deny their interest or proceed further if you are interested.
Role and Responsibility of Chareematrimony.com Member
a) Members of freenikah.com are required to upload the most recent photos, which should not be older than three (three) months, to receive better responses. b) Members are urged not to engage in any business dealings with prospects. Members of freenikah.com are not permitted to ask for or give money to other freenikah.com members. When communicating with another individual, using abusive language is regarded as a breach of the terms and conditions.
c) As a free member of freenikah.com, you agree to regularly log in to your profile on the website or app and send automated messages to potential partners expressing your interest in them. If you have chosen a paid Chareematrimony.com package, you can send personalized messages to potential partners expressing your interest or responding to their inquiries. A member of freenikah.com is also able to read and respond appropriately to messages and expressions of interest sent to them by potential partners.
d) Any changes to the information provided in the customer's profile that is not updated on the freenikah.com website or mobile application may result in the suspension of their membership.
e) When his or her marriage is legally consummated, they should either erase their profile directly or notify customer service so that it can be done.
f) You won't publish or send any content that is threatening, offensive, sexually explicit, or against the interests of the country. If any illegal or offensive content is discovered, Nika Online maintains the right to suspend your profile and may also start the proper legal actions against you.
g) All users must submit a profile that includes all the details needed to create a matrimonial profile. Nika Online won’t be responsible for any harm or loss resulting from the omission of marriage-related information.
h) Nika Online makes no claims as to the legitimacy or legality of any content submitted by users. Age, occupation, religion, caste or creed, and other personal information may be included in this.
i) It is forbidden to use bots, EXEs, CGI, or other programs or scripts to see content on chareematrimony.com or its members' profiles or to contact, interact, or respond to them.

Medium of Communication with Charee Matrimony Members
1) The member of freenikah hereby agrees to receive communications, including promotional communications, from Nika Online or other portals controlled by Nika Online or their alliance partners by any form of contact, including electronic mail, calls, SMS, or Whatsapp messaging.
2) Through its automated system, freenikah Matrimony sends to its member (s) prospect profile (s) via photographs, documents, messages, and links. Freenikah Matrimony member acknowledges that the contact number provided for verification, or an alternate number, if one is offered, is not on the National Customer Preference Register or the Do Not Disturb list, and they agree not to file a complaint.
3) You have the option to set the frequency of your communications with freenikah Matrimony, such as fortnightly, exclusively on weekends, etc. By checking the suitable option on the website or app, you can also choose not to receive calls or texts from freenikah Matrimony, provided that you agree to be contacted by a relationship manager of the assisted service or elite service if your profile is one that has been shortlisted for their registered users
Disputes between Members
freenikah.com Members are completely in charge of communications (by any means) with prospects or the other way around. freenikah.com expressly disclaims any liability or responsibility for any financial transaction(s), exchange(s), interaction(s), or passing of information(s), etc. between any freenikah.com members via email, chat, interaction, WhatsApp, or any other method of communication between freenikah.com members whether using the website/app or otherwise.
Content Right
You accept that you alone are accountable and liable for the mandatory or optional information you provided on our website and information, such as the profile details, photo, and other content(s), keyed in the appropriate field of the Website or App at the time of creating the freenikah.com profile or subsequently modified by you. You also acknowledge responsibility for all posts and communications, such as personalized messages sent by freenikah.com paid members with other users (s). Third-Party website
The members of freenikah.com acknowledge and agree that freenikah.com may also permit third parties to offer freenikah.com members services on the Website/App, and freenikah.com may also collect payment for such third-party services from you, and freenikah.com may also have revenue-sharing arrangements with such a third party. However, in no case shall freenikah be liable to you for such third-party services.
Any moment it sees fit and without prior notice, freenikah.com maintains the right to add, delete, alter, modify, or suspend any or all of the freenikah.com Services. Members of free nikah.com can anticipate seeing the modification on the website/app.
Limitation of liability

freenikah.com will never be liable to you or any other party for indirect, significant, commendable, unintentional, special, or remedial damages, including also lost profits resulting from your use of the site, outside of places where such agreements are prohibited. freenikah.com grants you the liability for any cause, regardless of the nature of the activity, regardless of anything actually contained.
General
IIn accordance with clause 2(b) of these terms and conditions, we retain the right to suspend your profile and request a refund of any and all fees you have paid for freenikah.com services. If you make a false complaint about another prospect on our website or app, and we decide to suspend or delete that prospect's profile as a result of your complaint, we reserve the right to take appropriate legal (Civil/Criminal) action against you and demand payment for all costs associated with your careless, fraudulent, illegal, or unlawful behavior. Additionally, as stated in clause 2(b) of these terms and conditions, we reserve the right to suspend your profile and delete any and all payments you have made for the freenikah.com services.
Indemnity
You agree to indemnify and hold harmless freenikah.com, its affiliates, officers, directors, consultants, employees, and other partners against any loss, risk, claim, or demand, including reasonable attorney's fees, made by any outsider or third party resulting from or arising from your use of the Service in violation of this Agreement as well as from any violation of these Terms of Use and any breach of your representations and warranties.
By using our freenikah.com services, you consent to defend, indemnify, and keep harmless freenikah.com, its subsidiaries, affiliates, directors, officers, agents, and other partners and employees from any loss, damage, responsibility, claim, or demand made by any person through improper use of the services, including reasonable attorney's costs.
Termination

Your right to use or access the website/service upon termination or suspension of membership expires immediately. All sections of these terms and conditions, including without limitation the disclaimers and liability limitations, which by their nature should survive termination, shall survive termination. Any obligations that you have that arose or accrued prior to the termination of your access to and use of the Services shall survive such termination.
Jurisdiction and Applicable Law
The freenikah.com Members unconditionally agree that all such disputes and/or differences if any shall be governed by the Laws of India and submitted to the exclusive Jurisdiction of the appropriate court of law in Vadakara, Calicut, Kerala, India. The registration of freenikah.com membership and all freenikah.com services are deemed to have been entered into within the territorial Jurisdiction of Vadakara, Calicut, Kerala, India
Mode of Payment
freenikah.com uses third-party payment gateways for collection payment through credit/debit cards or other payment instruments. Payment made by cash/cheque / Net Banking / Debit / Credit Card/ PayPal/ RTGS/ NEFT/ would be in accordance with the prevailing RBI guidelines. Activation of paid freenikah.com service shall be subject to the realization of the said payment. In case of dishonour of the Cheque/demand draft; you shall be liable to pay the applicable bank`s cheque/DD bouncing charges. Further freenikah.com service to your account will be deactivated/suspended until you settle the value of the payment and applicable bank charges in cash.
Refund and Assignment
freenikah.com members shall not assign or transfer your freenikah.com membership to any other person or entity, and such an act shall be treated as a violation of terms and conditions and freenikah.com shall retain their right under clause 2 (b) of this terms and conditions. The payments made by any freenikah.com members by way of membership/renewal fee/auto renewal are treated as non-refundable
Force Majeure
Nika Online shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause.
Force Majeure
freenikah.com members shall not assign or transfer your freenikah.com membership to any other person or entity, and such an act shall be treated as a violation of terms and conditions and freenikah.com shall retain their right under clause 2 (b) of this terms and conditions. The payments made by any freenikah.com members by way of membership/renewal fee/auto renewal are treated as non-refundable
The portal does not state any authority over the content that is posted on the website. It also does not take any responsibility for error, deletion, omissions, interruptions, delay in the process of transactions, line failures in communication, theft, or unauthorized access to any information of a member/visitor. The services provided are available in the AS-IS form. The portal does not take any responsibility for the conduct of any user.
Additional terms and conditions applicable to Non- Resident Indian customers.
A. Jurisdiction
Laws of India shall be applicable.
B. Arbitration of Disputes
The Parties shall discuss among themselves and resolve any disputes informally. We are interested in attempting to resolve any Disputes by amicable and informal means, and we encourage you to contact us before resorting to arbitration. If the dispute is not resolved within 30 (thirty) days from the date of such dispute, then such dispute may only be resolved through an individual arbitration conducted in accordance with the provisions of The Arbitration and conciliation Act, 1996, by a sole arbitrator. The seat of Arbitration shall be held in Vadakara, Kerala, India. We shall appoint the sole arbitrator. The arbitration proceedings shall be conducted in the English language.
C. However, Disputes relating to infringement of our intellectual property rights, which we may elect to have resolved by means other than arbitration
D. In case of Renewal, Customer is charged the current price that prevails, and renewal is done only for 3 months duration irrespective of the past package.
E. Enforcement
Any proceeding to enforce this arbitration agreement may be brought in the Courts of Vadakara, Kozhikode, Kerala, India.
